promoting and merchandising the sale of hair care products, namely, shampoo, conditioner, hair repair treatment, sculpting lotion, sculpting gel, scultping spray, sculpting foam, hairspray, and the like in beauty salons by rewarding franchisees which perform to certain standards, as indicated by customer satisfaction and sales levels, with the right to use the mark in advertising as a designation of the special status so awarded to those salons
